Being a parent is not protected by federal law, but employers need to be aware of caregiver discrimination or family
responsibility discrimination (FRD), which occurs when workers are discriminated against, based on their responsibilities to care for children, parents, or other family members.

Even though caregivers are not specifically protected by legislation; employees can claim this type of discrimination based on other laws, such as the Americans with Disabilities Act (ADA), Title VII, the Family and Medical Leave Act (FMLA), the Equal Pay Act, and the Pregnancy Discrimination Act.

5 Tips for a successful, updated company policy

  1. Clearly explain caregiver discrimination and related terms;
  2. Describe common stereotypes or biases about caregivers that may result in unlawful conduct;
  3. Provide examples of prohibited conduct related to workers' caregiving responsibilities (e.i.: stereotypical comments);
  4. Prohibit retaliation against individuals who report caregiver discrimination; and
  5. Designate an individual or office that may be contacted for questions or complaints regarding caregiver discrimination.
